UK legislation has increasingly placed Duty of Care firmly at the feet of the company directors and fleet managers. Through a combination of the Health & Safety at Work Act 1974 and common law, the employer must take reasonable steps to protect its drivers and third party members of the public. While many employers believe that if company vehicle MOTs are up to date, and insurance is valid then they are doing enough to protect themselves from being sued. Unfortunately this isn't the case, and Directors and Managers may be personally liable for any injury suffered where a company vehicle is involved. For example, if your Health & Safety policy does not require employees to take regular breaks from driving then you might be found liable for any back injuries that could reasonably be linked to extended periods of enforced sitting.
